GoldKOBO Business Policies/User Agreement

THESE POLICIES/AGREEMENT SETS FORTH THE TERMS AND CONDITIONS UNDER WHICH GoldKOBO SERVICES PROVIDES ITS SERVICES. THIS AGREEMENT DESCRIBES USER'S RIGHTS AND OBLIGATIONS WHEN USING THESE SERVICES. USER SHOULD READ IT CAREFULLY AND BE SURE USER UNDERSTANDS THESE TERMS AND CONDITIONS.

CONTINUED ACCESS TO GoldKOBO WEBSITE AND USE OF ANY GoldKOBO SERVICE MEANS USER ACCEPTS ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.

THE PARTIES TO THIS AGREEMENT ARE GoldKOBO SERVICES AND THE USER.

1. Description of GoldKOBO Services:

•  GoldKOBO is a DIGITAL GOLD UNITS exchange service enabling Nigeria residents to purchase digital gold values using the Nigerian national currency, the Naira, and also withdraw their digital gold values into Naira.

•  User acknowledges that GoldKOBO is not a bank, is not subject to banking regulations and does not hold any value on account for User.

•  GoldKOBO services is independently operated and is neither endorsed by nor affiliated with e-gold Ltd, Omnipay, G&SR, GoldMoney or any other digital gold values operator.

2. Know Your Customer (KYC) Policy:

•  User registering at the GoldKOBO website MUST provide GoldKOBO with valid and accurate information. GoldKOBO Services reserves the right to request additional documents to validate user information and identity as determined from time to time by GoldKOBO Services. This is a due diligence requirement to avoid fraud and maybe required by regulations to perform this task.

3. Exchange Policies and Agreements:

•  All transactions into or out of or between accounts of Digital Gold Values operators shall be subject to the Terms & Conditions of those operators as outlined on their respective web sites.

•  The user is solely responsible to provide valid and accurate information needed to complete GoldKOBO orders.

•  The user is solely responsible for all payments, even if the instructions provided by user are incorrect.

•  Users must be aware that transfer of Digital Gold Values into wrong Digital Gold Values accounts due to wrong account numbers given by the user are not reversible. GoldKOBO have no powers to retrieve Digital Gold Values placed in another users account. You simply must give us the correct account number to prevent this from happening.

•  GoldKOBO orders are binding contracts between the user and GoldKOBO Services and will be honoured by the user. Payment must be good funds of the exact amount specified in the user's order, net of all fees.

•  If the user fails to remit good funds of the exact amount specified in the users order, net of all fees, GoldKOBO Services, at its sole discretion, may reduce the GoldKOBO exchange order to the amount of funds received.

•  If the user remits more than the amount of good funds necessary to fulfill their order, net of all fees, then GoldKOBO, at its sole discretion, may: (i) adjust the users order to the exact amount of funds received,(ii) enter a new order for the amount of the excess funds received at the exchange rate at the time of the entry of the new order.

•  GoldKOBO Services reserves the right to assess and collect fees for its services. All fees are disclosed on the GoldKOBO.com website and automatically are calculated and disclosed before User confirms an Exchange order. GoldKOBO Services reserves the right to change its fees prospectively at any time and at its sole discretion.

•  Payment may not be counterfeit or otherwise fraudulent. The user agrees that any attempt to remit fraudulent funds will result in prosecution to the fullest extent of the law and the notification of the general public of user's actions at GoldKOBO's discretion.

•  Payments are final and not reversible except as provided in this Agreement.

•  Any tax consequences of GoldKOBO Exchange orders and or transactions are the sole responsibility of the user.

•  The Digital Gold Value payment to the Digital Gold Value account nominated by the user in their order will occur, subject to availability, within 72 hours of the funds being fully cleared and received to the satisfaction of GoldKOBO Services.

•  GoldKOBO Services reserve the right to refuse service to particular individuals or entities, at our sole discretion, with or without cause. NO correspondence will be entered into.

•  GoldKOBO Services reserve the right to report any fraudulent activity to the appropriate authorities.

•  GoldKOBO Services will not be responsible for delays or failures in the transmission, receipt or execution of orders, remittances, payments, or information due to events or systems beyond its control. The obligations of this contract precede any government enactment. GoldKOBO Services, it's owners, employees, agents or affiliates will not be responsible for any loss, damage or injury resulting from any event or system beyond its control.

•  GoldKOBO will not fulfil any exchange transactions ordered by the user if the user uses, or attempts to use the GoldKOBO Exchange service in connection with tampering, modifying or otherwise corrupting the security or functionality of the GoldKOBO Exchange services. Additionally, the user will be subject to damages and other penalties, including criminal prosecution where available and the notification of the general public of the user's actions, at the sole discretion of GoldKOBO Services.

•  GoldKOBO Services will not fulfil any exchange transactions ordered by the user, if ordered not to do so by an order from a court or arbitration body of acceptable jurisdiction or gold supplier such as e-gold for example, or as determined by GoldKOBO Services.

•  The user is solely completely responsible for the Digital Gold Value account given in any order to GoldKOBO and the contents and disposal of contents thereof. GoldKOBO will not be held responsible for the use or disposal of the value or contents of any Digital Gold Value account. This especially includes investment programs. We are not affiliated to, nor do we endorse investment programs. If our banner or link appears on any such program this is merely an advertisement of our services. We stress the danger involved in any such programs and suggest extreme caution before spending any amount of Digital Gold Value.

4. Referral Program Terms and Condition

•  The Referral Income program is only open to existing active customers who must complete at least one (1) Buy Gold transaction with us within every sixty (60) days interval and who enroll non-customers members into the program through GoldKOBO.com.

•  For every customer you refer who joins GoldKOBO.com, you will earn 10% of the Interchange Fee we charge for every Buy Gold transaction.

•  The appropriate Amount of money will only be credited to your account once your referral has paid and completed their Buy Gold transaction.

•  GoldKOBO Services reserves the right to cancel this offer at any time.

•  You may refer as many new customers as you like to GoldKOBO.com and you will earn Referral Income on their every Buy Gold transaction.

•  GoldKOBO Services will not be responsible for referral email messages that are sent by customers that are undeliverable or cannot be opened by the recipient.

•  The ecard you send to your friends will be the only communication they receive from us until they have joined GoldKOBO.com and agreed to our Business Policies. Their email address and details will not be used for any other purpose until this time.

•  GoldKOBO Services reserves the right to change, suspend or discontinue any aspect of the Referral Income program pages, including the availability of any features, information, database or content or restrict your access to parts or all of the offer pages without notice or liability.

5. Exclusions and Limitations of Liability
The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, GoldKOBO Services;

•  Excludes all representations and warranties relating to this website and its contents, including in relation to any inaccuracies or omissions in this website; and

•  Excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised GoldKOBO of the possibility of such potential loss) or any indirect, consequential and incidental damages.

•  GoldKOBO Services does not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

•  GoldKOBO Services reserves the right to make changes to the contents of this website, including to the descriptions and prices of goods and services advertised, at any time and without notice.

7. Jurisdiction:

•  The GoldKOBO Service is available to Nigeria residents only. This Account Agreement is governed by the laws of The Federal Republic of Nigeria as such laws are applied to agreements entered into and to be performed entirely within Nigeria by Nigeria residents.

•  This Agreement constitutes the entire and whole Agreement between User and GoldKOBO and is intended as a complete and exclusive statement of the terms of the Agreement. This Agreement shall supersede all other communications between the parties. This Agreement may be amended only upon execution of a subsequent agreement or upon User's failure to object within 10 days to modifications posted on the GoldKOBO.com website.
